This website is operated by Sophie & Maeve. The terms “we,” “our,” and “us” refer to Sophie & Maeve. Sophie & Maeve provides this website, including all information, tools, and services available, to the user subject to their acceptance of the terms, conditions, policies, and legal notices set forth here.
By visiting our site and/or making a purchase, you participate in our “Services” and agree to be bound by these terms and conditions (“Terms of Use,” “Terms”), including any additional terms or policies referenced herein or accessible via hyperlink. These Terms apply to all users of the site, including but not limited to browsers, suppliers, customers, merchants, and content contributors.

Article 1 – Definitions
For the purposes of these Terms:

Withdrawal period: the period during which a consumer can exercise their right of withdrawal.

Consumer: a natural person acting for purposes outside their trade, business, or profession who enters into a distance contract with Sophie & Maeve.

Day: calendar day.

Ongoing transaction: a distance contract covering a series of products and/or services with delivery or purchase obligations spread over time.

Durable medium: any means that allows the consumer to store information addressed personally to them, enabling future consultation and reproduction in unaltered form.

Right of withdrawal: the consumer’s right to withdraw from a distance contract within the legal period.

Entrepreneur: Sophie & Maeve, offering products and/or services at a distance.

Distance contract: a contract concluded between Sophie & Maeve and the consumer within the framework of an organized distance selling system, exclusively through one or more means of distance communication until the contract is concluded.

Article 3 – Applicability
These Terms and Conditions apply to every offer made by Sophie & Maeve and to every distance contract or order between Sophie & Maeve and the consumer. Before concluding a distance contract, the text of these Terms will be made available to the consumer. If this is not reasonably possible, the consumer will be informed before concluding the contract that the terms can be consulted upon request.
If the contract is concluded electronically, the text of the terms may be made available electronically in a way that allows it to be easily stored on a durable medium.
Article 4 – The Offer
If an offer is limited in time or subject to conditions, this will be clearly indicated. The offer is not binding. Sophie & Maeve may modify or adjust the offer.
The offer contains a complete and accurate description of the products or services offered. Images used accurately represent the products or services. Images and specifications are indicative and cannot justify compensation or contract termination.
Article 5 – The Contract
The contract is concluded when the consumer accepts the offer and meets the conditions. If acceptance is made electronically, Sophie & Maeve confirms receipt of this acceptance. Until confirmation, the consumer may cancel the contract.
Each contract is subject to sufficient availability of the products concerned.
Article 6 – Right of Withdrawal
The consumer may withdraw from the contract without justification within 30 days. This period starts the day after receipt of the product.
Article 7 – Costs in Case of Withdrawal
Return costs are borne by the consumer. Sophie & Maeve will refund amounts paid within a maximum of 30 days after withdrawal.
Article 8 – Exclusion of Right of Withdrawal
The right of withdrawal may be excluded for certain products, provided this is clearly indicated in the offer before the contract is concluded.
Article 9 – Pricing
Prices will not be increased, except for changes in taxes or VAT.
Article 10 – Conformity and Warranty
Sophie & Maeve guarantees that the products and services comply with the contract, the offer specifications, and reasonable quality and usage requirements.
Article 11 – Delivery and Performance
Sophie & Maeve processes accepted orders promptly, but no later than 30 days, unless a longer period has been agreed. In case of delays, the consumer will be informed within this period.
Article 12 – Fixed-Term Transactions
The consumer may terminate a fixed-term contract with regular deliveries at any time, subject to termination rules and a maximum one-month notice.
Article 13 – Payment
Unless otherwise agreed, amounts due must be paid within 7 business days following the start of the withdrawal period.
Article 14 – Complaint Procedure
Complaints regarding contract performance must be submitted clearly to Sophie & Maeve within 7 days of discovering the defect.
Article 15 – Disputes
Only Canadian law applies to contracts between Sophie & Maeve and the consumer.
